About This Agreement
Car Shipping Hawaii (USDOT 3505506 | MC 1158539) is a licensed, independent freight broker coordinating vehicle shipments between the US mainland and Hawaii. These terms govern all shipments arranged through Car Shipping Hawaii. By booking a shipment, the Customer acknowledges and accepts all terms below.

By shipper's signature or agent's signature, or as accepted online, Transport Company and agents, jointly and separately, are authorized to operate and transport vehicle(s) from the Point of Origin to the specified destination via a licensed, registered, bonded and insured auto carrier. Customer agrees and understands that Car Shipping Hawaii is a registered transportation auto carrier and property broker and is acting in the capacity as such.
Personal belongings are not to be transported inside the vehicle. In accordance with state and federal Department of Transportation laws, motor carriers are not licensed to transport personal cargo. The Transport Company advises the Customer to remove all personal belongings before transport. The Transport Company and Carrier shall not be responsible for the loss or damage to personal belongings, including any personal property left in the vehicle, or loss or damage to stereo equipment and non-stock items of the vehicle.
Shipper must furnish Transport Company or Carrier with necessary keys to vehicle and all compartments. Shipper is responsible for disarming any alarm or security system. In the event an alarm sounds and there are no keys or instructions to turn it off, Carrier may silence the alarm by any means necessary.
Carrier is authorized to operate and transport Customer's motor vehicle between its pickup location and the destination set forth on the shipping order and Bill of Lading.
Customer must prepare vehicle for transport. All loose parts, fragile accessories, low hanging spoilers, etc. must be removed or secured. Customer shall remove all non-permanent, outside mounted luggage and other racks prior to shipment. Vehicles must be tendered to Carrier in good running condition (unless otherwise noted) with no more than a 1/4 tank of fuel. Any part of the vehicle that falls off during transport is Customer's responsibility, including damages caused by said part to any vehicles or persons involved.
If authorized by the Customer, Transport Company and Carrier reserve the right to engage independent sub-contractors to transport or ship vehicle(s) from location to terminal and terminal to location. Such sub-contractors are required to have adequate insurance coverage and to provide proof of insurance to Car Shipping Hawaii or the Customer upon request. Their insurance is primary and is responsible for payment of any claims for loss or damage incurred while the vehicle is in their custody. In the event of damage incurred while the vehicle is in the care of an independent sub-contractor, all resulting claims must be directed to the company who physically delivered the vehicle and not Car Shipping Hawaii. If Carrier declines to pay for any claims or loss, the Transport Company will pay for damage if the Customer chooses to select the Transport Company's supplemental insurance policy. If Customer declines the supplemental policy, the Transport Company will not be responsible for damage incurred. As a courtesy, the Transport Company will, as necessary, act as agent in the claims process to facilitate expedient results.
No delivery time is guaranteed. All delivery dates are estimates only. Transport Company and Carrier do not agree to transport shipments in time for any particular market or event and will not be responsible for damages occurring by unavoidable delay. The Transport Company requires a two-day window for pick up and delivery in the event the Carrier faces a delay due to mechanical issues, road conditions or weather.
No auto rental will be honored for delays, damage, or accidents. No exceptions.
Carrier will pick up and deliver as close to Customer's door as legally and safely possible. A mutually agreed upon place to load or unload the vehicle(s) may be necessary due to low hanging trees or wires, narrow streets, or residential area restrictions.
At the time of pickup, Customer and Carrier will carefully inspect the vehicle for pre-existing damage (exterior only) by completing a vehicle inspection report recorded on the Bill of Lading. Both parties will acknowledge the condition of the vehicle and Customer will sign and receive a copy of the Bill of Lading.
At the time of delivery, Customer and Carrier will carefully inspect the vehicle for possible damages incurred during transit. Both parties will acknowledge the condition of the vehicle and Customer will sign and receive a final copy of the Bill of Lading.
Damage must be noted in the proper place on the Bill of Lading and signed by Customer regardless of weather conditions, time of day, or day of week. Signing the Bill of Lading without noting damage verifies that Customer has received the vehicle in satisfactory condition, and that Car Shipping Hawaii/Carrier and their agents are relieved of any further responsibility. Carrier damage claims are covered by a minimum of $75,000 public liability and property damage. All claims must be submitted in writing within 24 hours of delivery. Car Shipping Hawaii will share Carrier insurance policy details upon request.
Vehicle Preparation Reminder
Fuel must be at or below one quarter tank. The vehicle must be completely empty of personal items. This is enforced at the mainland port terminal and again during Hawaii agricultural inspection. For the full preparation checklist, see our Shipping Checklist.
Deposit Credit
Payment Terms
Shipper shall pay all costs, including storage and additional delivery costs, incurred as a result of shipper's breach of any obligation under this agreement, including inability to provide sufficient funds or inability to be present for accepting the vehicle. Consignee agrees to meet the Carrier's driver at the specified and agreed upon time and place. In the event of a payment dispute between shipper and Consignee, the party responsible for placing the order bears 100% responsibility for payment of the invoice.
Upon acceptance, shipper and receiver of vehicle(s) are jointly liable for all charges due for shipment. They will be responsible to pay all costs of collections, including court costs and attorney's fees, with interest at 1.5% per month or 18% per year.
Consignee is responsible to be at the scheduled delivery point at the specified time and place. If Consignee is unable to be present, the prescribed port storage fee per day will be charged. The Transport Company and Carrier will not be held liable for any non-use charges including auto rentals, interest, or other charges due to delay or damage to vehicle.
Shipper shall pay an additional fee for each inoperable vehicle. If a vehicle is rendered for shipment and later becomes inoperable, the fee will be assessed along with any other charges incurred to accomplish delivery, including but not limited to wreckers, forklifts, or roll-backs.
Nothing in this agreement binds carrier to pick up and/or deliver to locations from which it is impractical to operate Carrier's equipment because of inadequacies of highway, street, or passageways, or loading and unloading facilities, local, state or federal.
If a vehicle is vandalized while awaiting shipment (prior to pick up or after delivery), Transport Company and Carrier will not be held responsible. Owner will have to submit a claim to their own insurance or absorb the loss. Shipper agrees that their vehicle is insured and their insurance has primary responsibility.
Payment for transport is due at or prior to time of delivery. No exceptions.
Carrier shall be entitled to a general lien on any and all property of Applicant in its possession, custody and control for all sums and/or claims for outstanding charges, expenses, and/or storage costs incurred by Carrier in connection with any shipment.
As outlined in Section 10761 of the Interstate Commerce Act, the payment of freight charges may not be postponed due to alleged loss or damage. These charges should be paid in full and the portion applicable to the lost or damaged item should be included in the freight claim.
Claims and payment of freight charges are two entirely different transactions. ICC regulations prohibit withholding payment of freight bills due to a pending claim. Without payment of the freight charges, payment for transportation has not been made. A valid claim will not be paid until freight charges are settled.
Deposit Terms
Your deposit is applied toward your total, never added on top. Door-to-port deposit: $600. Port-to-port deposit: $200. The deposit secures your vessel space and locks your all-inclusive rate at the time of booking. All deposits are non-refundable. See the Cancellation Policy section for credit eligibility.

All deposits paid to Car Shipping Hawaii are non-refundable. The deposit secures your vessel space and locks your all-inclusive rate at the time of booking. Our services are considered rendered when a Carrier is assigned or a Matson booking confirmation has been logged. The option to cancel without additional fees (beyond deposit forfeiture) is available provided the order has not yet been assigned to a Carrier and the Matson booking has not been made.
Car Shipping Hawaii does not issue cash or credit card refunds on deposits under any circumstances. At the sole discretion of Car Shipping Hawaii, a deposit credit toward a future shipment may be offered on a case-by-case basis. If approved, the credit is valid for six (6) months to one (1) year from the cancellation date. Customers seeking a credit review must submit a written request to info@carshippinghawaii.com within 30 days of cancellation.
Cancellation of an order must be submitted in writing via email to info@carshippinghawaii.com and confirmed by phone call.
Once a Carrier has been assigned, the Transport Company notifies the Customer via email to the address provided at booking.
If Customer cancels the shipping order after a transporter has been assigned, a $150.00 service fee will be assessed as our services have been rendered upon carrier assignment.
If Customer reserves with another broker or company while under contract with Car Shipping Hawaii, with no opportunity to fulfill the contract or no notice of cancellation given, the deposit will not be refunded and no credit will be issued.

Liability Exclusions
Car Shipping Hawaii and the Carrier will not be responsible for the following. Customers are encouraged to photograph the vehicle thoroughly before drop-off or carrier pickup.
Damage caused by acts of God, hail, storm damage, or damage resulting from worn or broken parts of the vehicle, or added personal items left inside the vehicle.
Any glass damage.
Mechanical or electrical functions and damage caused by failing mechanics, electrical demise, alignment or suspension, exhaust assembly, muffler, or tail pipes. No exceptions.
Undercarriage damage, and damage resulting from overloaded or lowered vehicles.
Shipper is responsible for preparing the vehicle for shipment — securing loose parts, mufflers, tail pipes, spoilers, non-stock kit additions, antennas, and switches. Any part that falls off during transport is Customer's responsibility, as are leaking fluids, including damages caused by said parts or fluids to any other vehicles involved. It is the Customer's responsibility to notify the Carrier of all fluid leaks.
Vehicles that cannot be driven on or off a transport truck under their own power.
Vehicles with defective or insufficient brakes, parking brake, or parking gear.
Damage caused by freezing of engines, cooling systems, or batteries.
Any convertible tops that are loose, torn, or show excessive wear.
The Carrier will not be responsible for damage not caused by the driver.
The Customer agrees that their vehicle is insured and their insurance company has primary responsibility. This agreement supersedes all prior written and/or oral agreements between Car Shipping Hawaii and the shipper.
Before You Drop Off
Photograph your vehicle from all angles — exterior, interior, and undercarriage — before handing it to any carrier or dropping it at the port. This documentation is your evidence if any damage claim arises. Any damage not noted on the Bill of Lading at the time of delivery is considered accepted by the Customer.
How to Cancel
Claims, Repairable Losses, and Venue
Claims
Claims must be made in writing within 24 hours from the time of delivery. Any damage must be noted on the Bill of Lading at the time of delivery without exception. All claims for hidden damage must be made in writing and sent via certified mail within 48 hours after delivery. Hidden damage means losses or damages to parts contained within the underside of a vehicle that require the vehicle to be hoisted on a lift to be viewed. The party claiming hidden damage has the burden of proving the damage did not exist prior to Carrier's receipt of the vehicle. Photos and two (2) repair estimates should be submitted as soon as possible. All claims are subject to a deductible and will be settled at actual cost.
Repairable Losses
The amount of a claim for a repairable loss shall be established by a competitive bid process: the lowest available bid from two (2) competing qualified automobile repair shops. Alternatively, the Carrier may obtain an appraisal from an independent automobile insurance adjustment company. A qualified body shop includes any shop owned by a franchised dealer or the vehicle's manufacturer. Carrier may, at its option, accept a single bid presented by the claimant as the most effective settlement. Payment of any claim by the Carrier shall be deemed full and final resolution, and the shipper shall release the Carrier from any further liability involving the same vehicle.
Total Losses
The Carrier's limit of liability for any total loss vehicle(s) shall be the actual cost of any verifiable expenses thereon, including Carrier's freight charges. With respect to any total loss vehicle(s), the Carrier shall not be responsible for any lost profit.
Venue
This agreement and all suits or special proceedings hereunder shall be construed in accordance with the laws of the State of Missouri (unless prompted by applicable federal law). The venue for any action brought by either party shall be in the district court for the county of Laclede, State of Missouri, and any other venue is hereby waived.

Additional Services
Optional Supplemental Insurance
The supplemental insurance agreement provides the Customer with added protection in the event the Carrier fails or denies a claim for damage caused by the Carrier's own negligence. The Transport Company will pay for damage repair only. The policy does not cover losses arising from acts of God, damage to personal cargo left in the vehicle, or auto rental while repairs are being performed. By waiving this service, Car Shipping Hawaii will not be responsible for any damage caused directly by the Carrier or any claim denied by the Carrier. The additional cost of optional supplemental insurance is non-refundable.
Insurance Coverage at a Glance
Layer 1 — Overland transport: up to $100,000 cargo insurance provided by the land carrier. Layer 2 — Ocean transport: Matson carrier liability covers actual damage up to approximately $8,000 for an average-sized vehicle. You may declare a higher vehicle value on the Dock Receipt to increase this limit. We always recommend verifying with your personal auto insurance whether your policy covers ocean transport.
Expedited Pick Up
The Expedited Pick Up service provides guaranteed vehicle pick up. The Transport Company offers this at no additional charge within a two-day to five-day window. If Customer requires pick up limited to a one-day to two-day window, expedited service fees may apply and will be disclosed prior to execution of the transport contract. The Transport Company will arrange for an independent sub-contractor to pick up or deliver and have the vehicle safely stored at a secure port location. If Customer declines expedited pick up and cannot accommodate the Carrier's three-day to five-day window, the Transport Company and Carrier will not be responsible for local transport and storage fees. The additional cost of expedited pick up service is non-refundable.
Customers who require more than the allotted days of free port storage will be held responsible for all storage fees prior to pick up or delivery. If storage beyond one week is needed, an additional weekly rate may be applied.
